Title Issue Update - minutes of meeting

Below is the update for today meetings in SUK Building Shah Alam:-

MESYUARAT MEMBINCANGKAN PERKEMBANGAN PROSES MENDAPATKAN SURAT HAKMILIK KEPADA PEMILIK-PEMILIK RUMAH-RUMAH TERES TAMAN SRI ANGSANA HILIR,AMPANG.

The Meeting contents as follows:-

1. YB Iskandar giving a briefing regarding the previous meeting held on early of January 2010. The previous meeting resolved that:-

a. PTG will identify a solution to resloved the discharge of title for our terrace houses.

b. HLB Ler Lum will provide a proposal for discharge of title to PTG and YB Iskandar.

c.PTG will identify active caveats from 300++ caveators in order to find solution to resovled the title issues.

2. Encik Mohd Rashidi brief that PTG Hulu Langat does not yet prepare the latest caveats update due to incomplete documents. Most of the documents at PTG HQ Selangor. He further ,mentioned that on JANUARY 2010, the liquidators had performed payment for the ‘cukai tanah’ and HLB Ler Lum had overpaid the tax amount RM 86,000 overpaid amount to PTG. Hence, the step recommended by Dato Nasir in 1st meeting to possess the land is unenforceable due to Ler Lum had paid the ‘cukai tanah’ due to PTG.

3. Encik Mohd Rashidi further comments that no action can be taken to resolved the title issue due to HLB Ler Lum not yet apply for subdivide. Furthermore, HLB Ler Lum still not yet do submission to PTG the pre comm from authorised land surveyor. The pre com should be submitted for MPAJ approval.

4. Encik Awang from MPAJ mentioned that pre comm might had been done but not yet submitted for approval. Encik Faizal comments that we had meets Encik Awang and aware of the pre comm requirements and we had once in past year request quotation for land survey for the master title.

5. Encik Faizal further comments that the pre comm cost should be divided equally to to the terrace house owners, condo’s owners, commercial areas owners and low cost owners. He then suggest a meeting should be called with each group representative to discuss regarding the fee to be paid for the master title pre comm fee.

6. YB Iskandar mentioned that last month HLB Ler Lum submitted a letter to YB Iskandar c.c. to PTG regarding the concern from HLB Ler Lum to strike off the title for terrace house and request PTG to waive the necessaries fee.

7. Encik Faizal further mentioned that PPTSAH agreed to paid the pre comm cost but only for terrace house owners but for the rest of the owners for low cost, condo’s, commercial area should have the responsibility to settled the fee for their area. YB Iskandar comments that they will have problem to settled down the pre comm fee for low cost and condo’s area.

8. Encik Faizal suggested that the next round meeting should also included HLB Ler Lum and AMBANK. YB Iskandar, PTG and MPAJ agreed with the suggestion.

It was resolved during the meeting that :-

1. PTG will prepare a report of all caveats, to identify active caveat for next action.

2. Preparation of Pre comm for the master title in order to proceed for the 2nd stage for subdivide.

Overview of meetings:-

1. PTG is not well prepared for the meeting and the officers attending the meeting is not well prepared.

2. It seems PTG Hulu Langat had a conflict with State Land office due to PTG Hulu Langat does not have complete documentation for our title issue. Caveat report was pending due most of the caveat data was kept at State Land Office.

3. Lembaga Perumahan & Hartanah Selangor mentioned that in order to speedite the process, state government need to address all the caveats in single court application, means application to all caveators that are active.

4. Encik Faizal seek help YB Iskandar as state govt exco to monitor the following issues:-

i. Failure of HLB Ler Lum to issue consent letter to buyer promptly though 2% fee had been paid. A few case had been reported that takes HLB Ler Lum more than 2 months to issue Consent Letter though 2% payment was done to them.

ii. For YB to monitor the abandon condo accordingly especially on the illegal dumping, cleanliness and upkeep of the abandon condo’s & also fencing of the illegal condo’s to avoid further illegal dumping

The meeting was adjourned at 10.45am.

Illegal Dumping at Condo

KAWASAN PANGSAPURI TERBENGKALAI TAMAN SRI ANGSANA HILIR YANG DIGUNAKAN UNTUK TEMPAT MEMBUANG SAMPAH.

I received a copy letter from YB Iskandar Abdul Samad address to Y.Bhg. Dato’ Mohammad bin Yaacob, YDP MPAJ, c.c. copy to Y.Bhg. Datin Paduka Alinah Ahmad, Exe.Director Lembaga Perumahan & Hartanah Selangor, Tuan Haji Zainal Abidin bin Aa’la, D.O. Hulu Langat, and Encik Faizal, Chairman, PPTSAH regarding the illegal dumping.

Content of letter regarding YB Iskandar instruction to request MPAJ to instruct liquidator, HLB Ler Lum to fence the area and to ensure the abandon condo’s will not be used as illegal dumping area.

According to YB, as per Akta Kerajaan Tempatan 1976 (Akta 171), Land owner or premise owner have the obligation to ensure the cleanliness and upkeep of the land OR Local Council (MPAJ) can issue compound and upkeep the place cost bare by premise owner or Land owner.

Pihak Unit Komunikasi Korporat (UKK) telah menerima aduan melalui panggilan telefon daripada Puan. Lau Ai Nah beralamat No.1 , Jalan Hilir 5 , Taman Sri Angsana , Ampang pada 28 April 2010 berhubung cara permohonan bagi Dust(Sound) Barrier bagi kawasan perumahan beliau yang terletak berdekatan dengan Lebuhraya MRR2. Beliau amat terganggu dengan bunyi dan juga asap kenderaan - kenderaan yang lalu lalang di lebuhraya tersebut.Pengadu juga berkata bahawa perkara sebegini mampu memudaratkan kesihatan penduduk kawasan terbabit terutama kanak - kanak dan juga warga emas. Dengan ini , beliau mewakili penduduk kawasan perumahan tersebut telah mengajukan aduan ini dengan harapan isu ini dapat diselesaikan dengan segera oleh pihak yang bertanggungjawab supaya hal ini tidak mengganggu kehidupan harian penduduk.

Waste Dumping @ Abandon Condo

Salam & Happy Morning to All

Please take note that MPAJ appointed contractor & Alam Flora had done the clearance of rubbish at the illegal dumping area located at the Abondoned Condo in our taman.

Kindly refer attachment for the before and after clearance pics.

Regarding the back-hoe rental, we will forward payment under association amount RM350.00 for the back-hoe rental and I will prepared a letter for reimbursement from MPAJ JKP Zon 16 head, Tn.Hj.Meor as he agreed to reimburse and sponsor the back-hoe rental.

UPDATE FOR TRIMMING OF TREE:

Today, the MPAJ Supervisor, Encik Zamri, will send his staff to our area for site visit and review regarding the trees issue.

Rubbish at abandon condominium.

Salam and Greetings again!

Recently, I received a few phone calls and complaints from our fellow residents regarding watse dumping at abondon condo’s located at Jalan Hilir 3 to our taman after Desa Pandan bridge (refer attachment pic).

Today, at 9:30am, I had met up with Encik Amran bin Ismail, the person in charge in Jabatan Perkhidmatan Perbandaran & Kesihatan MPAJ. The meeting result as follows:-

1. Fast action will be taken by MPAJ and Alam Flora.

2. First step is to seal the place by Alam Flora to avoid public to keep dumping rubbish to the area.

3. Encik Zamri,MPAJ appointed contractor and Alam Flora will conduct clearance of rubbish at that area within 2 weeks from now.

4. MPAJ request us to sponser back-hoe (jentolak) cost RM350.00 in order to clear up the abondon area- I HAD COMMUNICATE WITH TUAN HAJI MEOR, OUR MPAJ COUNCELLOR FOR ZONE 16 - HE AGREED TO SPONSOR AND WE NEED TO WRITE IN TO HIM.

5. Encik Amran proposal is after the rubbish clearance, a drain line will be dig using back-hoe infront of the abondon condo to block public from dumping rubbish at the area and a permenant notice board of MPAJ to restrain public from dumping rubbish will be place at the middle of the illegal dumping site.

At the same appointment, I had communicate with Dr. Umi Kalsum, whereby she incharge of prevention dengue and rats issue. She will communicate with me further within next week to set up a programme at our taman for dengue and rats prevention.

Latest Update from TSAHRA

Salam and Greetings to all.

Yesterday, at 2:30pm, I had a site visit with Encik Zahari bin Mohd Nor, the Engineer from Engineering Department MPAJ. Below are the conclusion of the meeting:-

1. Budget to upgrade Jalan Hilir 3 with curve at every house entrance at Hilir 3 is approved, amount RM 125K, budget under MAARIS, State Govt. Selangor. According to Encik Zahari, all the trees at the pedestrian lane infront of condo’s will be demolished and upgrade to new lane and every front entrance of house in Hilir 3 will be equipped with curve divider to ensure front houses will not be interfear with cars and motorbikes for safety of residents. They had requested me to make a survey regarding their MPAJ proposal with residents at Hilir 3. Please refer attachement for MPAJ drawing proposal.

2. Engineering Department had submitted budget request for approval to upgrade of stuck drainage system at Jalan H3(beside TNB & nearby our TSAH Guard House main entrance). Kindly refer attachment for pics.

3. Additional to no.2, MPAJ will also submit Budget for upgrade of railing system at end of Jalan H6- at the new drainage system-exit to
kampong- in order to avoid future crime scene and minimize criminals case at our taman. Kindly refer pics for the location.

4. Encik Zahari will request his team regarding Painting of road divider at our main entrance(nearby guard house) will be done by MPAJ
at any time.

5. A site visit will be arrange with Unit Kesihatan MPAJ to find solution regarding rats problem at our taman. ( I will meet up with Dr. Umi Kalsum from Jabatan Persekitaran dan Kesihatan on Friday, 16th April 2010)

6. MPAJ will speedite the process for our request for road hump at Jalan H5 for road safety purposes.

TNB latest news

Below is the update regarding the illegal tresspass of land under the TNB High Voltage Tower (Before bridge to Desa Pandan):


Today morning, at 13/11/2009 @ 11:46am received sms from Encik Meor, he forward the sms received from Encik Addy, the Enforcement Unit Director, MPAJ as follows:

“UNTUK MAKLUMAN TUAN, PEMBAKARAN TERBUKA DI HUJUNG JALAN HILIR 3 DI ANGSANA HILIR MENGHALA KE DESA PANDAN SEBELAH KANAN ADALAH DI DALAM KAWASAN DBKL DAN PIHAK JABATAN TELAH MEMANJANGKAN ADUAN TUAN KEPADA PIHAK DBKL. TERIMA KASIH DIATAS KEPERIHATINAN TUAN”.

Now it seems that MPAJ takes more than 7 days to notify us that the place is under DBKL. A MAJOR CONFLICT ARISE HERE SINCE DURING THE MEETING WITH DBKL and MPAJ OFFICERS INCLUDING ENCIK AWANG AND ENCIK HASROL- before the bridge is under the boundry of MPAJ and DBKL boundry is after the bridge.

Due to unsatisfaction answer from MPAJ, I had sms to YB Iskandar as Exco Infra of Selangor State to seek his advice and he had sms me as follows:-

“SAYA AKAN TULIS SURAT KEPADA DBKL AND JABATAN ALAM SEKITAR (J.A.S)”.

Anyway, we just wait for the reply and response from TNB regarding the status of the land as the land is under Rentis TNB.

Dear Encik Shah Nawaz,
Salam and Greetings from us at Taman Sri Angsana Hilir Residents Association.

We would like to seek your kind co-operation to advice us regarding the following matter.

We notice that before the bridge to Desa Pandan, under the High Voltage Tower, there are a group of people which exploring the land to convert it as nursery. We need your co-operation to clarify the followings:

1.  Do they have the permission from TNB to used the rentis land?

2.  Can they perform open burning under the high voltan tower? It’s happen since past 2 to 3 weeks.

3.  We had check with MPAJ regarding this matter and they keep domain and silence without any clarification and justification regarding this matter.

Lawatan tapak & siasatan telah dijalankan.
Lokasi: Talian 132kV AMPG-PMJU/275kV AMPG-PULU antara menara 10-11.

Findings:
1) Memang terdapat aktiviti pembakaran bawah talian bagi tujuan tapak nurseri baru. Aktiviti ini adalah salah & pasukan aktiviti talian telah isu notis kepada mereka.
2) Mengikut makluman, pemilik telah membuat permohonan untuk tapak nurseri kepada TNB.
3) Setelah disemak, memang terdapat 1 permohonan untuk menggunakan tanah rezab bawah talian bagi tujuan nurseri di mana pemohonnya adalah: -

Mohd Asha’ari Bin Hashim, SA 32-1-A, Lorong Pandan Pertama 3, Pandan Utama, 68000 KL
Rozmanita Bin Ariffin, Blok E 13-1-5, Desa Pandan, Jln Kampong Pandan 55100 KL

4) Permohonan tersebut baru diterima pada 8 Jan 2009 & masih dalam proses.

Conclusion:
1) Aktiviti membakar bawah talian adalah amat merbahaya & notis telah diberi
2) Kawasan tersebut masih belum memperolehi kelulusan rasmi daripada TNB

Below is the update for a few matters :-

1. ILLEGAL TRESSPASS OF LAND UNDER THE TNB HIGH VOLTAN TOWER (BEFORE BRIDGE TO DESA PANDAN.

I had lodge report to MPAJ and Encik Meor regarding this matter for more than 3 times but unfortunately no update regarding the status of the case had been given by the enforcement division MPAJ.

I had done my owned investigation, and from reliable sources, the person who had done the illegal burning and nursery at the land had been given the rights by TNB to operate the nursery due to the land are under TNB rentis land.

Hence, I will counter check with TNB to check the validity of the above info.

2. APPLICATION OF FENCING PERMIT AT THE KAWASAN LAPANG:

Encik Hasrol the Director of Engineering had called me last Friday. REGRET TO INFORM THAT THE LETTER WE SUBMIT BY HAND ON THE 8TH DECEMBER 2009 IS NOT DETECTABLE BY HIM! It might been lost or untraceable!
I had re fax the letter to him today morning. And we had to wait for his response.

3.  PLAYGROUND APPLICATION AT THE KAWASAN LAPANG:

The application now under review from the Jabatan Belia dan Masyarakat. According to the jabatan, their officers had visited our kawasan lapang for site visit. Hopefully the result is positive.

4.  LAND TITLE ISSUE UPDATE :

As Mr. Raymond Lee is extensively liase with Encik Meor for the update. It was informed that YB ISkandar is working out this matter with PTG and other relevant parties involved.

Encik Meor informed last week that, a meeting within YB Iskandar, our rep and PTG negeri and daerah will be held this week. But up to date no news from YB Iskandar regarding the meeting.

Salam and Greetings to all!

Please take note that I had submitted the both letter of Request for Fencing Permits and Request for Playground letter to various department MPAJ today noon.

Regret to informed that all the head of department is not around, on annual leave ( Tuan Hamid, TYDP- at mecca performing hajj, Tuan Hasrolnizam, Director of Engineering, his at overseas. Tuan Awang,Director of Town Planning, on annual leave for 1 week, Tuan Drs.Sarodin, Jab.Belia & Masyarakat, meeting out of office)

Anyway, please refer attachment for PROOF OF RECEIVED both letter from the various department MPAJ.

Then, I will be meeting up with Encik Meor, our Zone 16 councellor at around 5.00pm today nearby angsana hilir to give the letter to him.

To update regarding MPAJ appointed contractor for rubbish collector:-

Dengan segala hormatnya pertemuan dan dialog antara AJK-AJK PPTSAH dan Yang Berbahagia Tuan dan Ahli Majlis Zon 16, Tuan Haji Meor Rithuan bin Mohamed Said pada 6hb Ogos 2009 dengan ini adalah dirujuk.

Adalah dimaklumkan bahawa pada pertemuan tersebut, kami ada menyuarakan hasrat kami untuk memagarkan kawasan lapang tersebut dengan kos di tanggung oleh penduduk-penduduk taman dan memohon kepada MPAJ untuk diadakan satu kawasan taman permainan mini untuk kanak-kanak di kawasan lapang tersebut.

Maklum balas Yang Berbahagia Tuan pada masa itu adalah bahawa MPAJ sedia untuk mempertimbangkan permohonon tersebut. Justeru itu, kami dengan amat berbesar hati memohon Permohonan untuk Peruntukan Taman Permainan Kanak-kanak di Taman Sri Angsana Hilir bertempat di kawasan lapang di Taman Sri Angsana Hilir. Rasional permohonan kami adalah berdasarkan fakta berikut :-

Taman Sri Angsana Hilir adalah sebuah taman yang telah di bina lebih dari 15 tahun. Selama ini, sehingga ke hari ini, tidak ada lokasi atau pembinaan kawasan permainan kanak-kanak di bina untuk kemudahan rekreasi penghuni-penghuni taman dan kawasan persekitarannya.

Penghuni-penghuni terutamanya kanak-kanak penduduk Taman Sri Angana Hilir dan kawasan sekitarnya terdedah kepada bahaya kemalangan jalan raya dan kemalangan diri kerana selama ini penduduk-penduduk menjalankan aktiviti riadah di atas jalan raya dan kaki lima di hadapan rumah mereka.

Kami difahamkan bahawa tapak lokasi taman permainan kanak-kanak di Taman Sri Angsana Hilir, di kawasan lapang bersebelahan kawasan deretan kedai (kawasan komersil) telah ditukar status kepada kawasan komersil dan kini di miliki persendirian. Pada pandangan kami, ia adalah satu tindakan yang tidak wajar kerana kepentingan awam tidak di nilai secara terperinci dan sesungguhnya penduduk-penduduk taman dan kawasan persekitarannya menghadapi masalah kemudahan awam yakni tiada kawasan taman permainan kanak-kanak dan riadah.

Justeru itu, berdasarkan justifikasi kami di atas, kami memohon jasa baik Yang Berbahagia Tuan agar dapat mempertimbangkan peruntukan untuk mengadakan satu kawasan permainan kanak-kanak berlokasi di kawasan lapang tersebut.

Sukacita dimaklumkan juga, demi keselamatan penduduk-penduduk taman dan kawasan persekitarannya juga, Persatuan Penduduk bersetuju untuk menanggung kos pagar keselamatan (Security Railing) di sekitar kawasan lapang untuk menghindar kanak-kanak bermain dijalan raya utama di sekitarnya.

Oleh yang demikian, adalah menjadi harapan kami agar pihak Yang Berbahagia Tuan dapat mempertimbangkan permohonan kami untuk mendapatkan peruntukan taman permainan kanak-kanak di kawasan lapang tersebut.
